Terms of Service
— Last updated September 23, 2026 —
These Terms are a contract between you and Kitchen Wizard, Inc. ("Kiwi", "we", "us"). By creating an account or using the Kiwi app, you agree to them.
1. Who may use Kiwi
You must be at least 13 years old to create an account. If you are under 18, you may use Kiwi only with the involvement of a parent or guardian. You may create an account for your household, and you may enter information about the people you cook for, including children — but you may not create an account on behalf of a child, and children may not have their own accounts.
2. Your account
You sign up with an email address and a password. You are responsible for keeping your password confidential and for activity under your account. Tell us promptly at support@kitchenwizard.ai if you believe someone else has accessed it. One person, one account; do not share credentials.
3. What Kiwi does
Kiwi generates suggested meal plans and grocery lists from the preferences you give it, using automated systems including third-party artificial-intelligence services. It also lets you save your own recipes, import recipes from web pages, photos and text you provide, and track what you have cooked.
Kiwi's output is a suggestion, not an instruction. Recipes, cooking times, quantities, nutrition figures and allergen information are generated automatically and may contain inaccuracies. You are solely responsible for what you buy, cook and eat.
4. Price and payment
Kiwi is currently free to use. We expect to introduce a paid subscription with a free trial; if we do, we will tell you in the app before anything is charged. Where a purchase is made through the Apple App Store or Google Play, that store processes your payment and its terms govern the transaction, including its refund policy — we cannot issue refunds for store purchases. Subscriptions renew automatically until cancelled; you cancel through the store account you bought them with. Prices may change on notice, effective at your next renewal.
5. Your content
Recipes you create or modify, notes you add to your account, and preferences you enter remain yours. You represent that you own or have the necessary rights to all content you submit to your account, and that it does not infringe any third party's copyright, trademark, privacy or other rights. You grant us a licence to store, process and display that content for the purpose of operating Kiwi for you — including sending it to the AI services described in the Privacy Policy so that Kiwi can generate your plans. This licence ends when you delete the content or your account, except for backups retained for the period described in the Privacy Policy.
You may not publish content to other Kiwi users at this time. If we introduce publishing, we will ask for the additional rights that requires before you use it.
6. Imported recipes
Kiwi can retrieve a recipe from a web address you supply, or read one from a photo or text you provide, and reformat it for your own private use. You are responsible for having the right to use anything you import. We identify our retrieval requests in good faith and honor site restrictions. We do not republish imported content to anyone else.
7. Acceptable use
By creating an account with Kiwi, you agree to use the services offered through Kiwi only for lawful, personal and non-commercial purposes and in accordance with these Terms.
8. Unacceptable use
Kiwi should never be used to break the law; do not attempt to access another user's data; do not probe, scrape or overload our systems; do not use automated means to generate volume beyond ordinary personal use; and do not reverse-engineer the service except where that right cannot lawfully be excluded.
9. Availability and changes
Kiwi is offered as-is and as-available. We may change, suspend or discontinue features. If we make a material adverse change to a paid feature, we will give notice and, where required by law, a pro-rata refund of the unused paid period.
10. Food safety, allergens and nutrition — please read this section
Kiwi's service, including meal plans, recipes and nutritional information, is not medical advice.
Kiwi asks about allergies and food avoidances and uses the information you provide to filter and flag recipes. That filtering is automated and it is not a guarantee. This filtering automation can miss an allergen based on the information provided — for example, where an ingredient's name does not disclose what it contains, where a recipe is imported from a third-party page, or where a product's formulation differs from the generic ingredient you disclosed.
You must read ingredient labels and always confirm for yourself that any food is safe for the people you are feeding. Do not rely on Kiwi as the sole safeguard against an allergen. If anyone in your household has a severe or life-threatening food allergy, treat Kiwi's output as a starting point only.
In addition, note that cooking involves inherent risks, including burns, cuts, or exposure to foodborne illnesses, and you are responsible for following safe food-handling practices. Consuming raw or undercooked meat, poultry, seafood, shellfish or eggs may increase the risk of foodborne illness.
Lastly, nutrition figures are estimates derived from public reference data and automated calculation. They are not verified by a dietitian, they are not medical or dietary advice, and they should not be used to manage a medical condition, including if you are pregnant or nursing. Consult a qualified professional for that.
11. Disclaimers and limitation of liability
To the fullest extent permitted by applicable law, Kiwi is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that any recipe will produce a particular result. To the fullest extent permitted by law, our total liability arising out of or relating to Kiwi will not exceed the greater of the amount you paid us in the twelve months before the claim or one hundred United States dollars ($100.00), and under no circumstances will we be liable for indirect, incidental, exemplary, special, consequential or punitive damages, whether in contract, tort, or any other legal or equitable theory.
Nothing in these Terms limits liability that cannot lawfully be limited or disclaimed under applicable law, including liability for personal injury caused by gross negligence.
12. Termination
You may stop using Kiwi and delete your account at any time from within the app; deletion is immediate and permanent, as described in the Privacy Policy. We may suspend or terminate an account that breaches these Terms, or where required by law. Sections 5, 10, 11, 14 and 15 survive termination.
13. Changes to these Terms
We may update these Terms from time to time. For material changes, or where required by applicable law, we will give notice in the app or by email before they take effect. Continuing to use Kiwi after that means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Subject to section 15, the state and federal courts located in Delaware have exclusive jurisdiction over any dispute that is not subject to arbitration.
15. Arbitration provision
This section applies to Kiwi users in the United States.
You and Kiwi agree that any dispute, claim or controversy arising out of or relating to these Terms, whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory, will be resolved by final and binding individual arbitration, not in court. You further agree that any arbitration shall be conducted only on an individual basis and not as a class, collective, representative or private attorney general action. This arbitration provision is governed by and shall be interpreted under the Federal Arbitration Act, 9 U.S.C. §§ 1–16. Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim qualifies and remains within that court's jurisdiction.
In the event of an arbitration, it will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect.
This section survives termination of these Terms or your account. The arbitrator, and not any federal, state or local court or agency, shall have the exclusive power to decide all matters, including without limitation the enforceability and arbitrability of this agreement. The parties acknowledge that this agreement to arbitrate will result in a waiver of their right to a court or to a jury trial for any claim related to Kiwi's services. If any portion of this arbitration provision is found unenforceable, that portion shall be severed and the remaining portions of this agreement shall remain in full force and effect.
